These Terms & Refund Policy ("Terms") govern your booking and use of cruises offered by Gungchil River Cruise ("Gungchil", "we", "us", or "our"), operating near Purbachal, Dhaka. By submitting a tour request through our website, or otherwise booking with us, you agree to these Terms.
1. Acceptance of these terms
Submitting a booking request — whether through our website, by phone, or in person — means you've read, understood, and agree to these Terms, including the refund policy in Section 4. If you're booking on behalf of a group, you confirm you have the authority to accept these Terms for the whole group.
2. Booking a cruise
A booking request submitted through our website is a request, not a confirmed reservation. Your tour is only confirmed once our team reviews the request and confirms a tour time with you. We may decline a request — for example if the requested date is fully booked, guest count exceeds a package's capacity, or the requested package isn't available on that date — and will let you know if that happens.
You're responsible for making sure the details you submit (date, package, guest count, contact number) are accurate. Please double-check before submitting, since changes after confirmation may be treated as a new request depending on availability.
3. Pricing & payment
Package tariffs, seating capacity, and timings shown on our site are indicative and subject to change without notice, and may vary seasonally or for group/private bookings. Confirmed pricing and payment terms (including any deposit required to hold your date) will be communicated to you directly by our team when your booking is confirmed. Payment methods and schedule are agreed between you and our team at that time.
4. Cancellations & refund policy
We understand plans change. Refunds for cancellations made by you are calculated based on how much notice you give before your scheduled tour date:
- 7 or more days before the tour: full refund of any amount paid, minus a small processing fee where applicable.
- 3–6 days before the tour: 50% refund of any amount paid.
- Less than 72 hours before the tour: no refund, as the boat and crew are already reserved for your slot.
- No-shows: treated the same as a late cancellation — no refund.
To cancel or reschedule, contact us as early as possible using the details in Section 11. Rescheduling to a different available date, where requested with reasonable notice, may be offered at our discretion instead of a refund, even inside the windows above.
Approved refunds are returned using the same payment method used to pay, and are typically processed within 7–10 business days of approval.
5. Weather & cancellations by us
If we need to cancel or reschedule your tour — due to weather, water conditions, mechanical or safety issues, or other circumstances beyond our control — you will be offered a full refund or the option to reschedule to another available date, at your choice. This applies regardless of how close to the tour date the cancellation happens, since it isn't a cancellation you initiated.
6. Guest conduct & safety
For everyone's safety and enjoyment on board, guests are expected to:
- Follow crew instructions at all times, particularly around safety equipment, boarding, and deck areas
- Supervise children and any guests who may need extra assistance
- Not bring items prohibited for safety reasons, or engage in behaviour that endangers themselves or others
We reserve the right to refuse boarding, or to end a tour early without refund, for guests who are visibly intoxicated, violent, or otherwise pose a safety risk to themselves, other guests, or crew.
7. Liability
You participate in the cruise and any onboard activities at your own risk. While we maintain our boats and follow standard safety practices, Gungchil is not liable for loss, damage, injury, or delay arising from circumstances outside our reasonable control, including weather, water conditions, or the actions of third parties. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
8. Privacy
Information you share with us when booking is handled according to our Privacy Policy, which explains what we collect and how we use it.
9. Changes to these terms
We may update these Terms from time to time to reflect changes in our operations or for legal reasons. The "Last updated" date at the top of this page will reflect the most recent revision. Continuing to book or use our services after changes take effect means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles. Any disputes arising from these Terms or your booking will be subject to the jurisdiction of the courts of Bangladesh.
